1、本项目招标文件中招标项目专用合同条款数据表〔房屋建筑工程设计合同〕第9项补充合同条款中的其他补充条款的第8小点内容修改为：“设计人未能按投标时的承诺派出主要设计人员的，应事先向委托人提出更换主要设计人员的书面申请，为此给委托人造成损失的，设计人应当予以赔偿。另设计人申请更换设计负责人且经发包人同意的，仍应支付****0元/人/次的违约金；更换其他人员且经发包人同意的，仍应支付****0元/人/次的违约金。如上述人员因刑事犯罪（因本项目犯罪除外）、伤病丧失工作能力、离职、死亡等设计人无法控制的原因设计人申请更换的（投标时设计人已能预见到会发生前述情况的除外，仍应支付违约金），经发包人确认属实的，可不支付前述违约金。但所更换人员的资质、经验和能力等不得低于被更换人员，对于设计负责人，经发包人同意更换的，所更换人选应为被更换人员同等职位或以上领导。设计人擅自更换设计负责人的，应向发包人支付******元/人/次的违约金，且发包人有权单方解除本合同；设计人擅自更换其他人员的，应支付******元/人/次的违约金。”
